(a)   DEFINITIONS:

(1)   Heavy vehicle: Any vehicle whose total weight is in excess of 12,000 pounds.

(2)   School bus: Every vehicle designed and used primarily to transport passengers to and from schools other than van-type vehicles.

(b)   The Governing Body of the City of Pretty Prairie, Kansas, deems it advisable to regulate certain vehicle traffic on certain streets in the City of Pretty Prairie, Kansas.

(c)   When signs are erected giving notice thereof, no person shall operate or park any heavy vehicle as defined in subsection (a), semi-trailer, or school bus, on any streets other than the following:

(1)   Booth Street from the intersection of Rhodes Avenue east to the intersection of Elm Street.

(2)   Main Street from its West intersection with Dean Road to the East city limits.

(3)   Christy Street from the intersection of Rhodes Ave. east to the intersection of Maple Street.

(4)   Santa Fe Street from the intersection with Pretty Prairie Road, north to the intersection of Christy Street.

(5)   Maple Street south from the intersection of Christy Street to the intersection of Main Street.

(6)   Elm Street north from the intersection of Booth Street to Main Street.

(7)   That portion of Walnut Street south from the intersection of Main Street for a distance of (1/2) one-half block.

(d)   Exceptions: The provision of this section shall not apply to the following:

(1)   School buses traveling that portion of Rhodes Avenue from Booth Street south to the intersection of Pretty Prairie road, and that portion of Elm Street from the intersection of Main Street north to the intersection of Christy Street.

(2)   To the use of a street or alley by a vehicle as herein defined solely for access to adjacent property as is necessary to serve that property, such as loading or unloading merchandise, furniture or other goods and may be parked only for so long as is reasonably necessary to complete the same.

(3)   Police, Fire, Ambulance or Emergency vehicles, while engaged in emergency activities, City, County or Franchised utility maintenance vehicles, while engaged in maintenance, repair or construction activities, garbage collection vehicles, while engaged in collection activities, U.S. Posta1 vehicles, moving vans while engaged in moving activities, construction vehicles engaged in construction activities for either City or private construction or building projects.

(e)   No person shall park any heavy vehicle or any semi-trailer, as defined in (a) hereof, on any street in the City of Pretty Prairie, Kansas, designated in (c) hereof, for a period longer than 2 hours.

(f)   Semi-trailers when parked without tractor must be dollied down onto railroad ties or heavy blocks to prevent breaking through the pavement. Should a trailer break through the pavement, the owner of that trai1er will be responsible for all costs in the repairing of the pavement.

(g)   It shall be unlawful for any person to drive, operate, or permit to be driven or operated any vehicle having a gross weight in excess of that gross weight listed on the vehicle registration for that vehicle anywhere in the City of Pretty Prairie, Kansas.

(h)   Statutes Incorporated. The following sections of Kansas Statutes are hereby incorporated by reference and shall become a part of this section as if fully set forth therein. Vehicle size and weight K.S.A. 8-1904(i)

(i)    Any person violating any of the provisions of this section shall be guilty of a misdemeanor, and upon conviction thereof, shall be fined the sum of not less than $25.00 nor more than $500.00; provided, however, that any person who, within the immediately preceding thirty (30) days has been convicted of a violation of any provision of this section shall be fined not 1ess than the sum of $100.00.

That is shall be unlawful for any person to park a motor vehicle in the center of Main Street; and that the only parking which shall be permitted along said street shall be when the vehicle is parked at, an angle to the curb according to markings; or parallel parking in residential areas which has been the custom. Violation of any section of this section shall be a misdemeanor and shall be punishable by a fine of not more than Fifty Dollars ($50) and/or by imprisonment for not more than thirty (30) days.
