It is the purpose of this Article to allow the Governing Body of Pretty Prairie, Kansas by resolution, to designate one or more Common Consumption Areas for a limited time and purpose within the boundaries of the city of Pretty Prairie, Kansas.

An indoor or outdoor area clearly marked using a physical barrier or any apparent line of demarcation, not otherwise subject to a license issued pursuant to the Kansas Liquor Control Act or the Club and Drinking Establishment Act, where the possession and consumption of alcoholic liquor is allowed pursuant to a common consumption area permit.

The Governing Body may by resolution establish and designate an area within the city limits of Pretty Prairie, Kansas as a Common Consumption Area for a specified length of time and hours of availability.

Common Consumption Areas may only be established and be under the supervision and control of the City of Pretty Prairie and its agents. This shall not prevent the City of Pretty Prairie from partnering with other private or public entities or contracting with private contractors to facilitate an event or security for a Common Consumption Area.

All Common Consumption Areas shall be maintained in conformance with state laws and regulations adopted by the Alcohol Beverage Commission.  A copy of this ordinance and subsequent resolutions contemplated herein shall be provided to the Alcohol Beverage Commission as required by law.

Prior to the commencement of any Common Consumption Area, the City shall provide notice to the Reno County Sheriff’s Office and any other appropriate law enforcement agency of the planned Area.

Any area designated for Common Consumption that includes a public street shall require that said street is closed for the designated period. No street closure shall prevent a citizen’s ability to access their home, and any limitation on access shall require alternative routes to be arranged by the City.

If in the sole discretion of the Mayor of the city of Pretty Prairie, activities within a Common Consumption Area have created a danger to the health, safety, or welfare of the public, the Mayor may cause an immediate closure of the Area. Upon direction of the Mayor, all indications of the Common Consumption Area will be immediately removed and all individuals participating in the event shall be required to disperse and lawfully dispose of any alcoholic beverages. Any participant who does not abide by this direction shall be subject to state laws and regulations adopted by the Alcohol Beverage Commission and the penalties therein.
